Reports and Data from 2006 RICO Case against Big Tobacco

In the fall 2023, after years of litigation, Altria Group, Philip Morris USA, R.J. Reynolds, and ITG Holdings finally began to display “corrective statement” signs in hundreds of thousands of retail points-of-sale throughout the U.S. These signs were displayed until the summer of 2025 and educated US consumers about the health risks of smoking and exposure to secondhand smoke and included admissions that the companies had manipulated cigarettes to make them more addictive. This action resulted from the landmark 2006 federal court ruling that the major tobacco companies had for decades fraudulently conspired to deceive the public about the health hazards of smoking in violation of the Racketeer Influenced and Corrupt Organizations Act.

Nearly 20 years ago, the tobacco manufacturers were ordered to disseminate “corrective statements” admitting their unlawful actions and providing truthful information on their products through newspapers, television, package inserts, corporate websites, and retail displays. The court-ordered disclosures were published in other channels years ago, but it took many additional years of litigation before the tobacco companies came to an agreement with the U.S. Department of Justice and a group of public health intervenors about how the court-ordered corrective statements would be displayed at retail points of sale. The intervenors included the American Heart Association, American Cancer Society, American Lung Association, Tobacco-Free Kids Action Fund, Americans for Nonsmokers Rights, and Center for Black Health and Equity.

The files listed below were produced to the intervenors as a result of the consent order and are not confidential. Store list data files include the name, address, and in-store marketing information for stores with tobacco marketing contracts. FTI Consulting was hired as the independent auditor and was responsible for assessing compliance with in-person audits, reviewing data, deploying the Tip Line, monitoring results, and providing reports to the working group. Reports, addendums, and other supporting exhibits from FTI Consulting, as well as additional files related to the case and marketing contracts are provided below.
