Welcome to the NFL PLAY 60 Challenge: Super Bowl Edition

The National Football League and the American Heart Association have teamed up to help New Orleans students to get 60 minutes of daily physical activity-both in school and at home and help your schools become places that encourage physically active lifestyles year-round.

Please register below and you will receive all the materials necessary to complete the Super Bowl Challenge and become eligible for great NFL rewards.

Please note: Materials will be mailed following on-line registration. Please allow 2-3 weeks for delivery. Once schools complete the 4 week Challenge, teachers must submit the Classroom Scoreboard and completed contest entry forms by December 17, 2012 in order to be eligible for rewards. Grades 4-6 are eligible to participate in the Super Bowl Challenge.

I. Limitation on Liability.
Except in jurisdictions where such provisions are restricted, in no event will We be liable to You for any indirect, consequential, exemplary, incidental, punitive damages, including also lost profits, even if We have been advised of the possibility of such damages.

NFL PLAY 60 SUPER BOWL XLV Challenge
OFFICIAL RULES

1. Eligibility: The National Football League (“NFL”) “NFL PLAY 60 Super Bowl XLVII Challenge” (the “Promotion”) is open to teachers of students in the fourth, fifth and sixth grades during the 2012 – 2013 school year, (“Teachers”) of students attending schools in Orleans, Jefferson, St. Charles, St. John, St. Bernard, St Helena, Washington, Tangipahoa, Livingston, St. Tammany, East Baton Rouge, Ascension, Assumption, St. James, Terrebonne, LaFourche and Plaquemines Parish in the state of Louisiana at time of entry. The NFL Entities (defined as the National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, NFL Enterprises LLC and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees), the American Heart Association, and each of their respective affiliates, officers, directors, and agents and all their respective subsidiaries, affiliates, retailers, parents, advertising and promotion agencies, and their immediate family members or persons living in the same household (whether related or not) are ineligible to participate. The Promotion is subject to all federal, state, and local laws and regulations. Void where restricted or prohibited by law.

2. Sponsor and Administrator: The sponsors of this Promotion are the National Football League, 345 Park Avenue, New York, NY 10154, and the American Heart Association, 7272 Greenville Avenue, Dallas, TX 75231, (collectively, the “Sponsor”).

3. Agreement to Terms and Conditions: By participating in this Promotion, each entrant fully and unconditionally agrees to and accepts these Terms and Conditions and must (i) submit the completed entry form and (ii) submit the completed Classroom Scoreboard. If an entrant violates or fails to follow any of these Terms and Conditions, that entrant will be disqualified.

4. Timing: The Promotion begins at 12:01 a.m., Eastern Standard Time, October 8 and ends at 11:59 p.m., Eastern Standard Time, on December 17, 2012 (the “Promotion Period”). Electronic entries must be received by the end of the Promotion Period. Mailed entries must be postmarked by the end of the Promotion Period and received no later than 11:59 p.m., Eastern Standard Time, on December 30, 2012.

5. How to Enter: NO PURCHASE IS NECESSARY TO ENTER OR WIN. Go to www.heart.org/superbowlchallenge and follow the links and instructions to register for the Promotion. Upon registration, the NFL will send you the required entry materials. The completed entry materials must be returned to the NFL (or postmarked) no later than December 17, 2012 (“Due Date”) either by mail, fax or PDF (“NFL PLAY 60 Challenge” Attn: Dan Rooney, 345 Park Avenue, 5th floor, New York, NY 10154, Fax: 212-847-1857 NFLPlay60@nfl.com. All entries must be submitted in English. All entries must be submitted on the official paper entry form or through the electronic entry form. No other paper, facsimile, or electronic entries will be considered. The Sponsor is not responsible for lost, late, stolen, delayed, destroyed, misdirected, illegible, or incomplete entries. Any use of mechanical, robotic, repetitive, automatic, programmed, or similar entry methods or agents is prohibited. Limit one entry per person (online or paper). All entries become the property of the Sponsor and will not be returned. Except as otherwise provided herein, information collected from the entrant is used only for the purpose of administering the Promotion, such as to notify a potential winner, and publicizing the Promotion, such as posting entries on a website publicizing the event. The entrant’s personal information will not be sold or shared with any other party and will not be used for marketing purposes by the Sponsor. Entries must include Promotion entry form and “Classroom Scoreboard” which includes how many minutes of physical activity their students achieved over the course of the NFL PLAY 60 Challenge.

6. Selection of Winners: All entrants into the Promotion who return completed entry materials by the Due Date will receive a reward.

7. Rewards: Rewards may include the following:

A. An NFL player school visit during the week leading up to Super Bowl XLVII, an invitation to attend Kids’ Day at the NFL Experience (“NFLX”). Estimated total retail value $1,000.

B. A trip to attend Kids’ Day at NFLX. Total estimated retail value $1,000.

C. A grant donation from NFL Charities and the American Heart Association for their school or after-school facility. The grant must be used to purchase new athletic equipment or allocated toward in-school or after-school health and fitness programming.

All rewards are non-refundable, non-redeemable, and non-transferable; no substitutions or cash equivalents allowed except by the Sponsor who reserves the right to award a reward of comparable or greater value if advertised reward is unavailable.
ALL TAXES, FEES, AND ANY INCIDENTALS AND OTHER EXPENSES NOT SPECIFIED HEREIN ASSOCIATED WITH A REWARD AND ITS RECEIPT, INCLUDING, WITHOUT LIMITATION TO, INCOME TAXES, ARE THE SOLE RESPONSIBILITY OF THE RECIPIENTS.

8. Publicity: Except where prohibited by law, participation in the Promotion constitutes each entrant’s consent to Sponsor’s use of each entrant’s first name, age, hometown, and state for administrative and promotional purposes related to the Promotion in any media now known or later developed, in perpetuity, without further payment or consideration. Each entrant grants Sponsor permission to publish, distribute, or otherwise make known to the general public the contents of their Promotion entry. Potential winners will be required to execute a publicity release entitling the Sponsor to use the entrant’s name, likeness, voice, opinions, biographical information, hometown, and state for promotional, commercial, or other purposes in any media now known or later developed, in perpetuity, without further payment or consideration.

9. Release and Indemnification: Each entrant hereby releases any claim against, agrees to hold harmless, and agrees to defend and indemnify Sponsor its respective advertising and promotion agencies, and each of their respective parent companies, subsidiaries, affiliates, partners, representatives, licensees, agents, successors, assigns, and each of their respective employees, officers, agents, representatives and directors, and all others connected with the Promotion from any and all liabilities, claims, actions, damages, harm, injury, expenses, and losses (including, without limitation, attorneys’ fees) of any kind or nature whatsoever in any way caused by or arising out of entrant’s participation in the Promotion, including, without limitation, property damage, personal injury, and/or death which may occur in connection with, preparation for, travel to, or participation in the Promotion, or possession, acceptance, and/or use or misuse of reward or participation in any Promotion-related activity, or any claims, including third-party claims, based on publicity rights, defamation, invasion of privacy, copyright law, trademark law, patent, or merchandise delivery.

10. General Conditions:Sponsor reserves the right to cancel or modify the Promotion if fraud, technical failures, mistake, virus, bug, or other cause beyond the reasonable control of the Sponsor impairs the integrity, security, or proper administration of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any entrant it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Terms and Conditions. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Promotion is a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.

11. Limitations of Liability: In no event shall the Sponsor, their respective affiliates and related companies, or their respective officers, directors, employees, or agents collectively herein be liable for: (i) entries not received due to or ineligible because of incomplete, unclear, indecipherable, or inaccurate information, delayed or failed network connections, or other mechanical or technical problems, however caused, including a busy phone signal; (ii) any failure of the website or features on the website during the Promotion Period, or for any problems with using the website, including the failure to have cookies enabled, or mechanical or technical malfunction of, or damage to, any telephone network or lines, computer online systems, servers, access providers, computer equipment, software; for failure of any email or entry to be received by Sponsor for any reason, including on account of human error or mechanical or technical problems or traffic congestion on the internet or at any website, or any combination thereof; for damage to an entrant’s or any other person’s computer or for breaches of privacy due to interference by third-party computer “hackers” or viruses, bugs or other problems, technical failures of any kind, including, but not limited to, the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries; or (vi) any injury, loss, claim, damage, or special, punitive, indirect, incidental, or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort, strict liability or otherwise, to persons or property, including, but not limited to, entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or that arise out of or are in any way connected with the use, or the inability to use, the registration website or the services or materials on the site, even if advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability of incidental or consequential damages so the above limitation or exclusion may not apply to you. Disputes: Entrant agrees that: (i) where not prohibited by law, any and all disputes, claims, and causes of action arising out of or connected with the Promotion, or any rewards awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the courts of the State of New York and the Southern District Courts of New York thereto in respect to any controversy which may arise out of or in relation to this agreement or its performance and each party hereby waives any objections to such jurisdiction and venue; and (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion but in no event may entrant be entitled to claim punitive, incidental, or consequential damages, or attorneys’ fees, and entrant hereby waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms and Conditions, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.

13. Winners List: A list of the schools receiving rewards may be obtained after January 30, 2013, and no later than February 28, 2013, by sending a self-addressed, stamped envelope to: NFL PLAY 60 Challenge, Attn: Daniel Rooney, 345 Park Avenue, 5th Floor, New York, NY 10154. The names of the schools will also be posted on www.heart.org/superbowlchallenge during this time period.
